A Responding Party can submit any defence open to it regardless of whether raised in prior correspondence. Also, the parties to a construction contract can adjudicate "at any time".

Pay the price or count the cost

If the court finds that a contract did not come into existence because the price was not agreed or because essential terms were not agreed or if work was carried out outside of the terms of the contract then the unpaid Contractor can claim an entitlement to be paid a reasonable sum by way of Quantum Meruit for the work carried out.
